![]() ![]() The Clerk is required to give notice of failure of service to the requesting party if the certified mail envelope is returned with an endorsement showing that the envelope was unclaimed. The date of delivery on a failure establishes the time used to calculate when the party is in default. If the delivery has been successful, the date of service determines the amount of time given to the opposing party to answer the complaint. The Clerk records the issuance of the notice of failure on the appearance docket and files the return receipt or returned envelope in the case file. If there is no attorney of record, the Clerk sends the notice of failure to the initiating party. If the Post Office returns the envelope showing failure of delivery, the Clerk issues a notice of failure to the attorney of record. The Clerk is responsible for promptly docketing the return of the certified mail receipt on the issuance docket and filing the return in the case file. The receipt also contains the signature of the person accepting delivery. The post office returns a certified mail receipt stating to whom the summons and complaint were delivered, the date of delivery, and the address where they were delivered. The Clerk dockets the issuance of certified mail on the appearance docket. Postal regulations permit the letter carrier to deliver certified mail to any adult at the delivery address, not necessarily only the party to whom it is addressed. The Clerk may require an additional deposit from the party who requests service to cover the additional cost of postage. The Clerk issues a summons and a copy of the complaint to the party in a sealed envelope as directed by the precipe. Under Ohio Civil Rules, service on parties within the United States will be made by certified mail unless another method is requested. To direct the court to serve a pleading, customers must complete a service of process precipe. The court can serve a pleading through certified mail, ordinary mail, personal service, residence service, or service by publication. To comply with due process requirements, service gives the opposing party reasonable notice of the lawsuit. When filing a pleading with the Clerk of Courts, a party to an action must indicate the method that the Clerk should use to serve the pleading to the opposing party. ![]()
